There are many reusers of Bharatpedia's content, and more are welcome. If you want to use Bharatpedia's text materials in your own books/articles/web sites or other publications, you can generally do so, but you must comply with the licence under which Bharatpedia's text is licensed. Many of the media files on Bharatpedia are also reusable. Each media file has its own licensing statement which must be verified, and reuse of any media file must comply with its licensing.

Neither Bharatpedia nor the authors of material on Bharatpedia provide legal advice. Bharatpedia's content is primarily intended to be governed by the laws applicable in India. Re-users should be aware that they may also be subject to the laws of other countries depending on where and how the content is reused. It is the responsibility of the reuser to determine how a licence applies to the intended reuse.

Additionally, while this document addresses copyright, other restrictions may apply. These may include personality rights, moral rights, privacy rights, trademark rights, or other legal rights which are independent of copyright and may vary by jurisdiction. If you have any questions about your intended reuse, you may wish to consult with an advocate or other qualified legal professional.

Text content[edit source]

Bharatpedia's text content can generally be used under the terms of the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA), unless otherwise indicated. The terms of use of Bharatpedia provide additional guidance on how content from Bharatpedia should be properly attributed when used under the CC BY-SA licence. The CC BY-SA licence imposes requirements which are set out in the text of the licence. The legal text of the licence is the only legally binding document; what follows is Bharatpedia's interpretation of how material may be reused under it.

Re-use of text under Creative Commons Attribution-ShareAlike[edit source]

Attribution: To re-distribute a text page in any form, provide credit to the authors either by including a) a hyperlink (where possible) or URL to the page or pages you are re-using, b) a hyperlink (where possible) or URL to an alternative, stable online copy which is freely accessible, which conforms with the licence, and which provides credit to the authors in a manner equivalent to the credit given on Bharatpedia, or c) a list of all authors. (Any list of authors may be filtered to exclude very small or irrelevant contributions.) This applies to text developed by the Bharatpedia community. Text from external sources may attach additional attribution requirements to the work, which should be indicated on an article's face or on its talk page. For example, a page may have a banner or other notation indicating that some or all of its content was originally published somewhere else. Where such notations are visible in the page itself, they should generally be preserved by re-users.

Copyleft/Share Alike: If you make modifications or additions to the page you re-use, you must license them under the Creative Commons Attribution-ShareAlike License 4.0 or later, as permitted by the applicable licence terms.

Indicate changes: If you make modifications or additions, you must indicate in a reasonable fashion that the original work has been modified. If you are re-using the page in a wiki, for example, indicating this in the page history is sufficient.

Licensing notice: Each copy or modified version that you distribute must include a licensing notice stating that the work is released under CC BY-SA and either a) a hyperlink or URL to the text of the licence or b) a copy of the licence. For this purpose, a suitable URL is: https://creativecommons.org/licenses/by-sa/4.0/

Images and other media[edit source]

While Bharatpedia's text is generally subject to the Creative Commons Attribution-ShareAlike License and can be used free of charge for any purpose so long as the licensing terms are met, other media (including images) may be identified as being subject to other licences or copyright restrictions. Each media file has its own information page which includes source and licensing information. Clicking on the media file will lead to this information page. Many media files are free to use as long as you follow the terms of the licences applied to them.

From the information page, to download an individual free image, first right-click "Full resolution" or the linked name of the image. Next, choose to save the image (the exact option depends on your browser). A brief overview of some of the licences that may be applied to media on Bharatpedia is available at Bharatpedia:Image copyright tags.

However, neither Bharatpedia nor the authors of material on Bharatpedia provide legal advice. It is the responsibility of the reuser to determine how a licence applies to the intended reuse and whether any other legal restrictions apply under Indian law or the law of the jurisdiction in which the material is reused.

Statutory exceptions and special requirements[edit source]

Bharatpedia may include limited quotations, images, sounds or other material whose use is permitted under an applicable exception to copyright under Indian law.

Indian copyright law provides specific exceptions under the Copyright Act, 1957, including the provisions of Section 52. Certain acts may therefore be permitted without the permission of the copyright owner where the requirements of the applicable statutory provision are satisfied.

In particular, Section 52 provides for certain forms of fair dealing, including fair dealing for purposes such as private or personal use including research, criticism or review, and reporting of current events and current affairs, subject to the statutory requirements.

Material used on Bharatpedia under a statutory exception is not automatically released under CC BY-SA.

It is therefore important to distinguish between material that is freely licensed and material that is merely permitted to appear on Bharatpedia under an exception to copyright.

Public domain materials[edit source]

Material that is in the public domain may generally be reused without obtaining permission from the copyright owner, subject to any other rights or restrictions that may apply.

Reusers should independently verify the public-domain status of material, particularly where the intended reuse is significant or commercial.

The copyright term and public-domain status of a work may depend on the type of work, the date of publication or creation, the identity of the author, and other circumstances under the Copyright Act, 1957.

Copyright and other legal restrictions[edit source]

Copyright is not the only legal consideration when reusing Bharatpedia content.

Other restrictions may include personality rights, moral rights, privacy rights, trademark rights, contractual restrictions, confidentiality obligations and other rights recognised under Indian law.

The CC BY-SA licence grants only the copyright permissions that the licensor is legally able to grant. It does not grant rights in trademarks, privacy, publicity, personality or other rights that are separate from copyright.
