In 2013, Zoernack and his investment fund EquityStar Global Partners faced scrutiny from the Securities and Exchange Commission (SEC) due to accounting errors by an independent accounting firm, Apex Fund Administration. Apex was found to have improperly classified salaries as "due from affiliate" rather than recording them as allowable fund expenses. Although Zoernack replaced the accounting firm and disclosed the error to investors, the SEC determined that he should be held accountable, resulting in a settlement and financial penalty.
