Hackman has only the middle six, which the British Library groups together under &amp;quot;&amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; (2)&amp;quot;, but has a number of references to owners, masters, and dates that make it clear that voyages 1-7 below are the same vessel.{{sfnp|Hackman|2001|p=102}} Hackman also states that after voyage #7, the government chartered &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; for a voyage transporting convicts to Australia. She made seven voyages for the EIC until in 1811-12 the government took her up to transport [[convict]]s to Australia in 1813. Captain Charles Raitt left Portsmouth on 5 June 1797 for [[Chennai|Madras]] and Bengal. The Indiamen &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039;, {{ship||Lord Melville|1803 EIC ship|2}}, &amp;#039;&amp;#039;Princess Mary&amp;#039;&amp;#039;, {{ship||Northampton|1801 ship|2}}, &amp;#039;&amp;#039;Anna&amp;#039;&amp;#039;, &amp;#039;&amp;#039;Ann&amp;#039;&amp;#039;, {{ship||Glory|1802 ship|2}}, and &amp;#039;&amp;#039;Essex&amp;#039;&amp;#039; left Rio on 13 October. They were in company with the [[Seventy-four (ship)|74-gun]] [[third rate]] [[ships of the line]] {{HMS|Albion|1802|6}}, {{HMS|Sceptre|1802|6}}, and {{HMS|Russell|1764|6}}, and the [[fourth rate]] {{HMS|Grampus|1802|6}}. Captain George Heming received a letter of marque on 21 July 1806.&amp;lt;ref name=LoM/&amp;gt; He sailed from Portsmouth on 9 August, bound for [[Mumbai|Bombay]]. &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; reached Rio de Janeiro on 13 November, the Cape on 15 January 1807, and Colombo on 5 April. Captain George Heming sailed from Portsmouth on 10 June 1808, bound for Madras and Bengal. &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; was at Madeira on 24 June, and arrived at Diamond Harbour on 16 November.&amp;lt;ref name=BL2/&amp;gt; On the way she and {{ship||Monarch|1800 ship|2}} rescued all of the passengers and all but 16 of the crew of [[Travers (1800 ship)|&amp;#039;&amp;#039;Travers&amp;#039;&amp;#039;]], which had hit a rock on 7 November at {{coord|15|38|N|94|20|E}}.&amp;lt;ref&amp;gt;&amp;#039;&amp;#039;Edinburgh Annual register&amp;#039;&amp;#039; (1809), pp.122-3.&amp;lt;/ref&amp;gt;&lt;br /&gt;

On 2 January 1809 &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; was at [[Kolkata|Calcutta]]. There Heming joined Captain Kymer of {{ship||Lord Castlereagh|1802 EIC ship|2}} and Captain Hawes of &amp;#039;&amp;#039;Monarch&amp;#039;&amp;#039; in letters of protest against the [[Royal Navy]]&amp;#039;s [[impressment]] of seamen from the ships; &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; had lost 23 men, including some petty officers, out of her crew of 87 men to the Navy.&amp;lt;ref&amp;gt;&amp;#039;&amp;#039;Papers relating to East India affairs&amp;#039;&amp;#039; (1810), p.49.&amp;lt;/ref&amp;gt; &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; was at Saugor on 14 March.&amp;lt;ref name=BL2/&amp;gt;&lt;br /&gt;

On 2 May 1809 she departed from the Sandheads with a convoy of four other [[East Indiaman|Indiamen]] and several smaller vessels, all under the escort of [[French corvette Revenant|HMS &amp;#039;&amp;#039;Victor&amp;#039;&amp;#039;]]. On 24 May a storm split the convoy and &amp;#039;&amp;#039;Victor&amp;#039;&amp;#039; and the small ships separately lost touch with the Indiamen. One of the five, {{ship||Monarch|1800 ship|2}}, had a leak that had worsened. She received permission on 25 May from Captain John Dale of {{ship||Streatham|1805 EIC ship|2}}, the senior EIC captain of the five vessels and so commodore, to sail to Penang. Hawes, &amp;#039;&amp;#039;Monarch&amp;#039;&amp;#039;{{&amp;#039;}}s captain, requested that another of the Indiamen accompany him in case &amp;#039;&amp;#039;Monarch&amp;#039;&amp;#039; foundered. Dale detailed &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; to go with &amp;#039;&amp;#039;Monarch&amp;#039;&amp;#039;. The three remaining Indiamen, &amp;#039;&amp;#039;Streatham&amp;#039;&amp;#039;, {{ship||Europe|1803 EIC ship|2}}, and {{ship||Lord Keith|1804 ship|2}} continued on their way while hoping to meet up with &amp;#039;&amp;#039;Victor&amp;#039;&amp;#039;. Under the command of William Mitchell, &amp;#039;&amp;#039;Earl Spencer&amp;#039;&amp;#039; left England on 2 June 1813. She sailed via [[Madeira]], escorted for the early part of the voyage by {{HMS|Kangaroo|1805|6}}, and arrived at [[Port Jackson]] on 9 October 1813.{{sfnp|Bateson|1959|pp=290-1}} She transported 200 male convicts, four of whom died on the voyage.{{sfnp|Bateson|1959|p=327}} An officer and 38 men of the [[73rd (Perthshire) Regiment of Foot|73rd Regiment of Foot]] provided the guards for the prisoners.
